RENTAL AGREEMENT

This agreement and our policies are in effect at time of order without signature or verbal acknowledgement.  Ordering Party is responsible for items during the rental.  Our signs and displays are the Property of Memorable Moments and for RENTAL purposes only.

We cannot set up our displays on hard surfaces concrete, asphalt, etc.  Front of residence ONLY.  No back yard displays. 

Generally we deliver and pick up within a window of 9 pm to Midnight.  However we strive to meet the requirements/requests of our customers.  We will do our best to accommodate all requests if possible.

Stork / Moon birth displays are 7 Days; & Other Celebration Displays that include our critters are 24 Hours.
 

Must be made within 24 hours prior to delivery date.  No exceptions.

Due at time of order. 

A Memorable Moments sign will be placed on the lawn with the Critter display.  DO NOT MOVE OR HIDE OUR SIGN.  A missing fee will be charged Even if our sign is recovered. 

Value of loss WILL be billed to rental credit card on file for applicable fees.

**This also includes Spotlights, Extention Cords, Metal Stakes, and Sign posts**
 

If you would like the sign or display set in a different space or removed, please call 847-922-3034.  Moving the signs or displays could result in damage or loss.  Applicable fees will be charged to rental credit card on file.
 

Displays and signs are designed for temporary display and viewing.  They are not strong enough to be hung on or rigorously handled, even by children.  This could result in damage and rental card will be billed for any damages.
 

Or any additional decoration to, or around our display. This could cause damage resulting in charges.

 They are very festive and can be tempting to want to pull out for a picture, but this could cause damage and result in additional charges. 

We appreciate you choosing Memorable Moments to be part of your celebration.  However we require that signs and equipment are taken care of and returned in the condition in which they were delivered.

Memorable Moments is not responsible or any City Ordinances or Violations for signs place in the yards. Please check with your local city hall or lawn decoration ordinances.  Should our property be picked up by local ordinance, ordering credit card will be billed for full value of items removed.

Memorable Moments and representatives are not responsible for any injury or damage cause to a person or personal property during the rental time period agreement. 

Will appear on your statements as Memorable Moments

Credit Card Holder on file will be billed with all the applicable Charges following the end of the rental period.

$25.00 Per Moved or Removed Sign

$30.00 Per Missing/Damaged/Stolen Sign- ex: Football, Golf ball, Baseball, Volleyball, Tennis Ball, Soccer Ball, Smiley Face, Grad Hat, Cow, Heart, Basketball, Buzzard, Star, Beer Mug, Flamingo, Tombstone, 2 foot letters or numbers, etc..

$120.00 per missing message board sign

$10.00 per Missing/Damaged Metal Sign Stake

$30.00 per missing metal U Post

$15.00 per missing Spot Light

$15.00 per missing Extension Cord

$400.00 per Stork/Flamingo/Moon Sign, or any portion of it (excluding white personalized coroplast keepsake)

Memorable Moments reserves the right to refuse service at any time for any reason.  Prices are subject to change without notice. 

All Rentals must be paid with Credit Card, Debit Card, or Cash on Delivery.

You will receive a full refund if:

• You cancel your rental at least 24 hours in advance
  
• Extreme weather conditions prevent us from setting up your display within 48 hours of original stork delivery date.
  

You will NOT receive a refund if:

• The homeowner stopped us from setting up the display
  
• The homeowner called us and asked us to remove the display
  
• Less than 24 hours notice is given to cancel the order
  
• The wrong address was give to us and we are unable to contact the homeowner or purchaser for the correct address.
  
• The stork can not be set up because we cannot gain access into gated community
  
• The homeowner has a dog loose on the property
  
• Or any other reason we cannot set up the display that is beyond our control.

Memorable Moments will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website:

• for any indirect, special or consequential loss;or
• for any business losses, loss of revenue, income, profits, or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss of corruption of information or data

Nothing in this website disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this website disclaimer will exclude or limit Memorable Moments liability in respect of any;

• death or personal injury caused by Memorable Moments negligence;
•  fraud or fraudulent misrepresentation on the part of Memorable Moments; or
• matter in which it would be illegal or unlawful for Memorable Moments to exclude or limit, or to attempt or purport to exclude or limit, it's liability.
